1. Acceptance of Terms

By downloading, installing, accessing, or using the Electricians Mate mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms") and the “LICENSED APPLICATION END USER LICENSE AGREEMENT” in this link: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If you do not agree to these Terms, do not use the App.

2. Description of Service

Electricians Mate is an AI-powered mobile application designed to assist electrical trade professionals with:

•  Technical calculations and references
• Code compliance guidance
• Project management tools
• AI-powered troubleshooting assistance
• Educational resources and training materials

3. User Accounts and Registration

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorised access to your account

3.2 Eligibility

• You must be at least 18 years old to use this App
• You represent that you have the legal capacity to enter into these Terms

4. Subscription Services

4.1 Subscription Plans

The App offers subscription plans with monthly billing. Current plans and pricing are available within the App.

4.2 Billing and Payment

• Subscriptions are billed monthly in advance
• Payment will be charged to your chosen payment method on a monthly basis
• Subscription fees are non-refundable except as expressly stated in these Terms

4.3 Subscription Cancellation

• You may cancel your subscription at any time through your account settings or app store account
• Cancellation will take effect at the end of your current monthly billing period
• You will retain access to features until the end of your paid monthly subscription period
• No partial refunds will be provided for unused portions of monthly subscription periods

4.4 Auto-Renewal

• Subscriptions automatically renew unless cancelled before the renewal date

5. Refund Policy

5.1 Free Trial Period

• You have the right to cancel during any free trial period up to and including the last day of the trial
• For example, with a 7-day free trial, you may cancel at any time during those 7 days without charge
• If you do not cancel before the free trial expires, you will be automatically enrolled in the basic subscription plan
• Cancellation during the free trial period must be completed before the trial end date to avoid charges

5.2 No Refund Policy

• All subscription fees are NON-REFUNDABLE once the free trial period has ended
• We do not provide refunds for any subscription fees, including:
  • Unused subscription time
  • Dissatisfaction with the service
  • Technical issues that may arise
  • Changes in personal circumstances

5.3 Consumer Rights and Exceptions

• Nothing in this refund policy affects your statutory rights under UK consumer protection law
• Refunds may be considered in cases of:
  • Duplicate charges due to technical errors
  • Unauthorised charges (subject to verification)
  • Legal requirements under UK consumer protection legislation
  • Rights under the Consumer Rights Act 2015 and equivalent Scottish consumer protection laws

6. Acceptable Use

6.1 Permitted Use

You may use the App solely for lawful purposes related to electrical trade work and professional development.

6.2 Prohibited Activities

You agree NOT to:

• Use the App for any illegal or unauthorised purpose
• Attempt to reverse engineer, decompile, or hack the App
• Share your account credentials with others
• Use automated systems to access the App
• Violate any applicable local, state, national, or international laws

7. AI and Technical Information Disclaimer

7.1 AI-Generated Content

• The App uses artificial intelligence to provide information and assistance
• AI-generated content is for informational purposes only and should not be considered professional advice
• You are solely responsible for verifying all technical information and calculations

7.2 Professional Responsibility

• Always consult current electrical codes and regulations
• The App does not replace professional judgement, training, or certification
• You assume full responsibility for all work performed using information from the App

8. LIMITATION OF LIABILITY

8.1 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR COMPLETENESS OF INFORMATION

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY UK LAW:

• TOTAL LIABILITY CAP: Our total liability to you for all claims related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim

• EXCLUSION OF DAMAGES: Subject to UK consumer protection laws, we shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Personal injury or property damage
  • Electrical work performed using App information
  • Downtime or interruption of service
  • Technical errors or inaccuracies in AI-generated content

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under UK law.

8.3 Professional Liability Disclaimer

• We are not responsible for any electrical work performed using App information
• Users assume all risk and liability for professional work and decisions
• The App does not provide professional electrical services or advice

8.4 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, government actions, or technical failures.

9. Intellectual Property

9.1 Ownership

• We retain all rights, title, and interest in the App and its content
• You receive only a limited licence to use the App according to these Terms

Nothing in these Terms affects your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015.
